Freehold

Last checked 13 October 2026 · Checked by the Property Centre content team

Freehold is a way of owning land in Kenya with no time limit: the owner and their heirs hold it indefinitely. Freehold land is registered with a certificate of title. Only Kenyan citizens can hold freehold land, which matters to diaspora and foreign buyers.

Also called: freehold land, freehold title, absolute ownership

What freehold ownership gives you

Freehold is the strongest form of private land ownership in Kenya. There is no lease and no end date. The owner can sell it, leave it to their heirs, charge it to a bank as security, or subdivide it, subject to planning rules and, for farmland, Land Control Board consent.

Freehold land is registered under the Land Registration Act 2012 with a certificate of title. Many freeholds were first registered under the old Registered Land Act, where the owner was called the "absolute proprietor". That is why sellers still advertise "absolute title" to mean freehold.

Who can hold it. Article 65 of the Constitution of Kenya allows non-citizens to hold land only on leasehold, and caps the lease term. When the Constitution came in, freehold interests held by non-citizens were turned into leases. A company counts as a citizen only if it is wholly owned by Kenyan citizens. Kenyans abroad who keep their citizenship can still buy freehold.

What the owner pays. Freehold land does not pay the national land rent that leaseholds pay to the government. Whether and how a county rates freehold land depends on that county's rating law, so ask the county for a rates statement before buying.

What still applies. Freehold does not free land from planning control. Change of user, subdivision and building plans still need county approval, and agricultural freehold land needs Land Control Board consent for a sale, lease or charge.

Differences by county

  • Central Kenya, Rift Valley and Western farmland: freehold is the norm on agricultural and rural land, much of it first registered after land adjudication.
  • Nairobi and other cities: freehold exists in some older suburbs, but most urban land is leasehold from the government.
  • Coast: a mix of freehold, leasehold and unregistered arrangements; check the title type carefully.

What to check

  • Confirm on the official search that the title is a certificate of title (freehold), not a certificate of lease.
  • If you are not a Kenyan citizen, take advice before buying: you can hold only a lease.
  • For farmland, budget time for Land Control Board consent.
  • Ask the county whether rates are charged and whether any are unpaid.

Red flags

  • A seller calling land "freehold" when the search shows a lease.
  • A foreign buyer being offered freehold title in their own name.
  • "Freehold" plots on a mother title with no individual titles yet.

Questions

What is the difference between freehold and leasehold land in Kenya?

Freehold has no end date. Leasehold lasts only for a fixed term and usually carries an annual land rent to the government. See the comparison table above.

Can foreigners own freehold land in Kenya?

No. The Constitution limits non-citizens to leasehold. See the figures box for the maximum lease term.

Is freehold land better than leasehold?

Freehold is more secure over time and has no land rent, but a long leasehold in a good location can be just as valuable. What matters most is a clean title and a correct search.

Do I pay land rates on freehold land?

It depends on your county's rating law. Ask the county for a rates statement before you buy.
